Vietnam’s Border Disputes: Legal and Conflict Management Dimensions
INTRODUCTION
The primary point of this analysis will be to examine the progress made in managing Vietnam’s border disputes. Another objective is to investigate the challenges which lie ahead pertaining to those border disputes that remain unsettled. Both the legal and the battle management dimensions of these disputes are addressed and examined.
The arrangements reached between ราชภัฏสวนสุนันทา and neighbouring countries are identified and also outlined. The remaining disputes are identified in relation to the essence of their respective differences. The persistence and changes in the methods to dispute settlements are all analyzed. The level of success in managing the boundary disputes is assessed. The challenges of managing the remaining unsettled disputes have been discussed.
Viet Nam’S BORDER DISPUTES
This summary of the way Vietnam’s border disputes have already been and are increasingly being treated will be broken up into 2 segments. The initial section addresses the border disputes which have been officially settled through arrangements or during joint-development arrangements. These disputes that are settled have been outlined in chronological order according to the year in which they were settled or so the very first agreement was first reached. The second section outlines the open border disputes.
Settled boundary disputes
About 18 July 1977 Laos and Vietnam signed a treaty delimiting their land boundary. Following completion of the demarcation process a complementary treaty has been signed on 24 January 1986. On 1 March 1990 another protocol has been signed was, about the exact same afternoon, an agreement on border law.
On 7 July 1982 Viet Nam and the then People’s Republic of Kampuchea (PRK) signed an agreement on”historic waters” at the Gulf of Thailand. On 20 July 1983 that the two states signed a Treaty on the principles to the settlement of border issues as well as an Agreement on boundary regulations. About 27 December 1985 the two countries signed the Treaty on the Delimitation of the Vietnam- Kampuchea Frontier. On 10 October 2005 that the two states signed an Supplementary Treaty to the 1985 Treaty.
About 5 June 1992 an agreement has been reached between Malaysia and Vietnam to participate in joint development in regions of overlapping claims to continental shelf are as lying into the south west of Vietnam also to the east north east from the east coast of Peninsular Malaysia.
On 9 August 1997 Thailand and Vietnam reached an agreement delimiting their continental shelf and Exclusive Economic Zones (EEZ) boundaries in a disputed area from the Gulf of Thailand to the Southwest of Vietnam and to the Northeast of Thailand.
About 30 December 1999 China and Vietnam signed a Land Border Treaty settling the territory border dispute between both countries. On exactly the exact same afternoon the two countries signed an agreement on fishery co-operation in the Gulf of Tonkin. On 29 April 2004 the 2 states signed the Supplementary Protocol to the Agreement on Fishery collaboration in the Tonkin Gulf and the Regulations on preservation and direction of their living resources in the Common Fishery Zone at the Gulf of Tonkin.
